Landlords Beware: Oregon House votes to restrict no-cause evictions, lift ban on rent control

On April 4, 2017, citing concerns about increasing rental costs and lack of affordable housing, the Oregon House of Representatives voted to advance legislation (HB 2004 A) that would require landlords to provide 30 days’ notice with cause for terminating tenancies of more than six months. 

This legislation would change the current law providing that a landlord may terminate a month-to-month tenancy of less than one year with 30 days’ no-cause notice, and tenancies of more than one year with 60 days’ no-cause notice. (Note: 90 days’ no-cause notice is required under a recent City of Bend ordinance for tenancies within Bend city limits.) 

The law would also require that fixed-term tenancies convert to month-to-month tenancies where the landlord does not offer to renew the fixed-term tenancy for an additional term. Landlords can avoid the above by providing 90 days’ written notice of termination without a stated cause. However, landlords renting more than four dwelling units who wish to take advantage of this exception must state in the 90-day notice the reason for terminating the tenancy and pay to the tenant one months’ rent. If a landlord fails to comply with any of the above, the tenant could sue to recover three months’ rent in addition to any damages incurred. The law would apply to new or fixed-term tenancies renewed after the effective date of the bill, and to month-to-month tenancies 30 days after the effective date. In addition, the law would allow cities and counties to adopt rent stabilization programs. The bill must still pass the Senate and be signed by the Governor before becoming state law.
